10-year-old to receive €2.9 million damages over injuries

A 10-year-old boy who suffered catastrophic injuries in the minutes after his birth at the Coombe Hospital in Dublin is to receive €2.9 million damages. Eoin Dunne of Malahide in Co. Dublin has dyskinetic cerebral palsy. He is wheelchair dependant and requires a feeding tube.

Earlier this year, following a 43 day hearing, the High Court found the hospital liable for the injuries he received as an infant.

Ms. Justice Mary Irvine found that had he been ventilated 9 minutes rather than 17 minutes after his birth he may not have suffered devastating injuries.

Today the court approved a damages settlement of €2.9 million. Mr. Justice Michael Moriarty called it a 'harrowing and enormously difficult case' and expressed happiness that discussions between the parties had borne fruit.

The care needs of the 10-year-old will be reassessed by the court in 2 years time.

Speaking outside court Eoin's mother Fiona Murphy said the settlement is a big relief and will allow her and her husband get on with looking after their son.
