Girl awarded €4.5 million in damages

The High Court has approved a €4.5 million settlement to a 6 year old quadroplegic girl in need of 24 hour care.

Kerry Brett from Fethard, Co Tipperary suffered severe brain damage during her delivery at St Luke’s Hospital, Kilkenny in October 2003.

Pregnant Clodagh Brett was ten days overdue when admitted to St Luke’s Hospital Kilkenny for induction on the 18th October 2003.

During labour, the court heard the medical care fell well below professional standards -and that her baby daughter Kerry was deprived of oxygen for 107 minutes causing brain damage that has left the now 6 year old girl with severe spastic quadroplegia and in need of 24 hour care.

The court heard St Luke’s Hospital only admitted liability in July this year, five years after an internal inquiry acknowldeged many system failures in her birth.

Kerry’s parents Brendan and Clodagh Brett say they plan to use some of the damages to build a new family home.
