Anglo Irish Bank has agreed to hand over confidential material to an investigation led by the Director of Corporate Enforcement.
The Commercial Court was informed the nationalised lender reconsidered a claim of privilege over data relating to employees following negotiations with the Attorney General and the Minister for Finance.
Anglo Irish Bank has agreed to hand over electronic documents containing information on about 20 members of staff to the Director of Corporate Enforcement as part of his investigation into practices at the bank.
However it has laid down conditions that the data cannot be handed over to third parties who may be considering bringing a civil action against Anglo.
Senior counsel Shane Murphy said the bank had a duty to defend its commercial interests which is now effectively the public interest because Anglo has been nationalised.
However the confidential documents can be handed over to the DPP in the event of any prosecutions.
