Garda has entire assault sentence suspended

A garda has walked free from jail after a judge today revised his sentence and suspended the balance of 18-month prison penalty given to the officer.

It was imposed for assaulting a man in Cork city almost 3 years ago.

Dean Foley had been sentenced yesterday to 18 months in jail yesterday with 12 months suspended by Judge Sean O’Donnabhain for assault causing harm to Stephen Murphy in Cork in September 2009.

25-year-old Foley pleaded guilty to assault causing harm to Murphy on the Grand Parade in Cork on September 12th 2009.

He was stationed in Bantry at the time.

The case against Foley who is currently suspended from the force was investigated by the Garda Ombudsman Commission.

Cork Circuit Criminal Court heard that Mr. Murphy suffered a broken nose, fractures to his cheekbones, broken teeth
and bleeding to the brain in the late night assault.
