Judicial powers Bill for repossessions withdrawn

Feb 3rd, 2012, 3:38 pm

The Independent TD Stephen Donnelly has withdrawn a proposed Bill to give judges powers not to order repossessions of family homes.

The Wicklow TD used 3 hours of a special Dáil sitting today to have the measures debated.

But it would have been defeated in a vote by the government next week.

Currently the judges have to enforce possession once the 1 year moratorium runs out.

He says he now intends to work with the Justice Minister to try and have some of the measures incorporated into the proposed insolvency and bankruptcy legislation.

Earlier Minister Alan Shatter says while laudable the Bill would probably have been unconstitutional.
