The Alameda County District Attorney's Office has launched a formal investigation into the balcony collapse in Berkeley that killed six Irish students and injured seven others.
It comes after authorities previously said that their probe into the collapse had finished.
The apparent u-turn was made after city officials said that wood supports holding up the structure had become 'severely dry rotted'.
It is believed the fallen balcony was detained by police as evidence, but has since been returned to the property manager.
The apartment building was completed just seven years ago.
The decision comes as the final funeral of the tragedy takes place in Dublin this morning. Lorcán Miller will be remembered in Shankill at 11am.
Henry Lee is a reporter with the San Francisco Chronicle.
He told told Breakfast Berkeley police have also done a u-turn - and say they will now be cooperating with the District Attorney in the investigation.
