A Co Clare doctor has gone to the High Court to challenge the introduction of free GP care for under-6s.
Dr Yvonne Williams, who is based in Shannon, claims the scheme will jeopardise her practice.
Dr Williams says the introduction of free under-6s GP care places her in an impossible position.
If she signs up to the new contract she fears this will lead to a dramatic increase in the frequency of visits by children under 6.
She does not believe her practice can accommodate the increased demand, and feels it would be unethical to enter a scheme that would compromise patient care.
However she claims if she does not sign up, patients with young children will go elsewhere - putting a practice with five staff members in jeopardy.
Dr Williams, supported by the National Association of General Practitioners, is seeking an injunction against the Health Service Executive (HSE) to stop the terms of her existing contract being amended.
Mr Justice Tony Hunt will hear the application next Wednesday.
