The High Court will decide tomorrow whether the criminal trial of Sean FitzPatrick, set for October, can go ahead.
Lawyers for the former Anglo Irish Bank chairman are seeking to overturn a decision in the Circuit Court earlier this month not to postpone the trial.
Counsel for Mr FitzPatrick said he was seeking an injunction against the Director of Public Prosecutions (DPP) to prohibit or restrain his client's continued prosecution.
Reporting restrictions have been placed on the hearing in the High Court today.
The 66-year-old - with an address at Whitshed Road in Greystones - denies 27 charges including making misleading, false or deceptive statements and furnishing false information between 2002 and 2007.
