Traveller woman loses Supreme Court appeal challenging school admissions policy

A Traveller woman has lost a Supreme Court appeal challenging the admissions policy of the Christian Brothers High School in Clonmel.

In an important test case, Mary Stokes had argued that the policy - which prioritises the sons of old pupils - amounted to indirect discrimination in relation to her son John.

John Stokes was refused a place in the Christian Brothers High School in 2009.

The Equality Tribunal found this was discriminatory - but the school won appeals at the Circuit Court, High Court and finally today at the Supreme Court.

The five judges have ruled against the Stokes on different grounds, relating to the sufficiency of evidence and the right of appeal under the Equal Status Act.

Brigid Quilligan of the Irish Traveller Movement told Newstalk Lunchtime that John Stokes is currently not attending any school.

While speaking to media outside court, Ms Quilligan said she is hopeful legislative change is on the way.
